An Update on SEC Marketing Rules

The SEC’s modernized marketing rule goes into effect on November 4th 2022 and is the first update to the SEC’s marketing and advertising regime in almost 60 years. The SEC has signaled that it will begin conducting marketing examinations shortly after the implementation date but complying with this rule may be challenging for private equity managers.
